Is a car crash the same as a big truck wreck?

Trucks Kill

Federal Statistics - The Federal Motor Carrier Safety Administration (FMCSA) reports that 37,133 lives ended in 34,247 fatal motor vehicle crashes. Over 5,000 lives were lost in 4,455 large truck and bus crashes. Fatalities have increased by 8% in recent years. Additionally, 17% of all truck and bus crashes resulted in occupants' deaths, a 7% increase over the prior statistical year.   Each year semi-tractor cases kill and injure the innocent.

Indiana Statistics - In 2018, 5,207 large truck crashes killed 146 persons. 96% of the fatalities are occupants of the passenger vehicle. Studies show that large trucks are difficult to stop, and under current regulations, the distance is slightly more than one football field.

FMCSR "The Rules"

Truck Drivers must follow all state laws, administrative rules, driving rules, and Federal rules in the safe operation of a big rig. The Federal Motor Carrier Safety Regulations set forth minimum standards for those involved with the operation of commercial motor vehicles.

Physics

Vehicle dynamics, including speed, delta-V, seatbelts, weight, braking, training, oversight, axonal rotation, and other physics, affect the outcome of big truck crashes. Therefore, it is essential to hire an attorney, investigative team, accident reconstructionist, and computer download of the "black box."

Hire an experienced, DOUBLE BOARD CERTIFIED, lawyer.

Qualified Attorney

Not every lawyer should handle a commercial motor vehicle case.  A lack of trials, settlements, and overall successes are factors to consider when hiring a legal trucking lawyer.  Retain the best lawyer for you and your case, and feel comfortable that your lawyer is doing their job.

Insurance Company

The insurance carrier is looking out for their interests and the truck driver.  Not your best interests.  Level the playing field by hiring a skilled, competent attorney that can "hit the ground running."   Witnesses' minds fade, evidence is lost, computer downloads are destroyed, and other proof factors may be lost if a qualified attorney is not immediately retained.  Help yourself and your family; hire a lawyer before they do.

Settlement or Jury Trial

More than 80% of cases resolve by way of settlement.  But what happens if your case is selected for trial, meaning the insurance company is arguing about liability or damages (money)?  In that case, a Board Certified lawyer should exhibit the skill, experience, and education to protect your rights in a jury of your peers.
